When a person creates an original work that is fixed in a physical medium, they automatically own the copyright to that work. Anime Shoe Shop accepts unsolicited designs from independent artists who are informed of and agree to Anime Shoe Shop’s policies regarding the intellectual property rights of others. All designs selected by Anime Shoe Shop are new, original, and/or transformative works that may parody, satirize, or comment on other copyrighted works. Anime Shoe Shop and its selected designs make only fair use of copyrighted works. We respect the intellectual property rights of others, and Anime Shoe Shop is not affiliated with the owners of the copyrights referenced in the selected designs.

It is the policy of Anime Shoe Shop to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and other applicable laws. Our response may include removing or disabling access to content claimed to be infringing. If we remove or disable access to content in response to a notice, we will make a good-faith attempt to contact the independent artist who submitted the design, allowing them to submit a counter-notification pursuant to Section 512(g)(2) and (3) of the DMCA.

Notice of Copyright or Other Intellectual Property Infringement

If you believe any of your intellectual property rights have been infringed by us or any user of the Site, please notify us. Pursuant to Section 512 of the Copyright Act, as enacted through the Digital Millennium Copyright Act (DMCA), Anime Shoe Shop designates the following individual as its agent for receipt of notifications of claimed infringement:

  6. A statement that the information provided is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the infringed right.

Failure to include all required information may render your DMCA notice invalid. By submitting a notification, you acknowledge that Anime Shoe Shop may remove or disable access to the infringing material without liability. Any claims from both the complaining party and the original poster of the material will be referred to the United States Copyright Office for adjudication under the DMCA.


Counter-Notification

If you believe that your content was removed or disabled by mistake, you may submit a counter-notification. To be effective, a counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and its location on the Site before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and phone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district where the site or the disputed material is located, if you are outside the U.S.), and that you will accept service of process from the complaining party or their agent.
